By accessing this website, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by Rainey Day Ripz.

We, Rainey Day Ripz, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms of Service will take effect immediately from the date of publication.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

• modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
• remove any copyright or other proprietary notations from any materials and software on this website;
• transfer the materials to another person or “mirror” the materials on any other server;
• knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service Rainey Day Ripz provides;
• use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
• submit false, misleading, or fraudulent information through the host waitlist form or the issue report form;
• use this website or its associated services in violation of any applicable laws or regulations;
• use this website in conjunction with sending unauthorized advertising or spam;
• harvest, collect, or gather user data without the user's consent; or
• use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Purchases From Our Machines

Rainey Day Ripz machines dispense sealed trading card product sourced through distribution. Nothing is opened, repackaged, or resealed before it reaches a machine. The price of each item is displayed on the machine's touchscreen before you pay.

Machines accept card and contactless payment only — Visa, Mastercard, Apple Pay, and Google Pay. They do not accept cash and do not issue change. All sales are processed by us, not by the business hosting the machine.

The contents of a sealed pack are determined by the manufacturer and are a matter of chance. A common or low-value pull is not a defect and is not grounds for a refund or exchange. We make no claim or representation about the odds, value, or contents of any pack.

Refunds and Returns

Sealed product cannot be returned once it has been opened. We will make it right in the following situations:

• the machine charged you and dispensed nothing;
• the machine dispensed an item other than the one you paid for; or
• the product reached you crushed, torn, or already open.

Approved refunds are issued to the original card used for the purchase only. We cannot issue cash, store credit, or a refund to a different card. How quickly the credit posts is determined by your card issuer.

Reporting a Problem

Report any issue with a purchase through our issue report form. Give us the store name, the city, and the date of purchase so we can match it against the machine log. We respond to every report within one business day during our support hours, Monday to Friday, 9am to 5pm.

The business hosting a machine does not stock it, service it, or process its payments, and its staff have no ability to look up a transaction or issue a refund. Please come to us directly rather than to the host's counter.

Host Waitlist Submissions

Submitting your business through the host waitlist form costs nothing and commits you to nothing. A submission is a request to be contacted — it is not an offer, an agreement, or a guarantee that a machine will be placed at your location.

Placement is limited by machine availability and by whether a location is a good fit. Any placement, including the revenue share, the term, and the responsibilities of each party, is agreed separately in writing before a machine is installed. Nothing on this website forms part of that agreement.

Intellectual Property

The intellectual property in the materials contained in this website is owned by or licensed to Rainey Day Ripz and is protected by applicable copyright and trademark law. We grant our users permission to download one copy of the materials for personal, non-commercial transitory use.

This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or the Terms of Service, and may be terminated by Rainey Day Ripz at any time.

Pokémon and all related names are trademarks of Nintendo, Creatures Inc. and GAME FREAK inc. Rainey Day Ripz is an independent reseller of sealed trading card product and is not affiliated with, endorsed by, or sponsored by them, or by any manufacturer or distributor whose product our machines carry.

Liability

Our website and the materials on our website are provided on an ‘as is’ basis. To the extent permitted by law, Rainey Day Ripz makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.

In no event shall Rainey Day Ripz or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website, the materials on this website, or any machine we operate, even if Rainey Day Ripz or an authorized representative has been notified, orally or in writing, of the possibility of such damage.

In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity or otherwise.

Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Product selection, pricing, and availability vary by machine and change without notice — the machine's touchscreen is the authoritative source at the time of purchase. These Terms of Service are governed by and construed in accordance with the laws of the State of North Carolina. You irrevocably submit to the exclusive jurisdiction of the courts of Mecklenburg County, North Carolina.

Text Message Communications

By submitting our forms and signing up for texts, you consent to receive text messages from Rainey Day Ripz at the number provided, including messages sent by autodialer. Consent is not a condition of purchase. Msg and data rates may apply. Msg frequency varies. You can unsubscribe at any time by replying STOP or clicking the unsubscribe link (where available), and no further messages will be sent. Reply HELP for help. Information will not be shared with third parties for marketing or promotional purposes.
